By purchasing, accessing, or using any service provided by NixeSolutions, you agree to these Terms of Service. If you do not agree with these Terms, you must not purchase or use our services.

1. Services

NixeSolutions provides VPN services, including personal VPN plans, group VPN plans, private VPN servers, reseller services, and other VPN-related digital products.

Service features, available locations, device limits, connection limits, and pricing may vary depending on the plan purchased.

2. Payments and Renewals

• Payment is required before a service is activated.
• Subscription-based services may automatically renew unless cancelled before the next renewal date.
• Customers are responsible for maintaining a valid payment method when automatic renewal is enabled.
• Failure to complete payment may result in suspension, expiration, or termination of the service.
• Prices may change at any time. Existing subscriptions will be handled according to the pricing and billing terms displayed on the customer account or checkout page.

NixeSolutions is not responsible for service interruptions caused by failed, declined, reversed, or disputed payments.

3. Refunds

Due to the digital nature of our VPN services, all sales are generally final.

Refunds are not guaranteed once a VPN service, configuration file, account, private server, or other digital product has been delivered or activated.

Please review our separate Refund Policy for additional information regarding refund eligibility.

4. Account and VPN Usage

Customers are responsible for keeping their account credentials and VPN configuration files secure.

Unless specifically permitted by the plan purchased, customers may not:

• Share VPN configuration files with other individuals.
• Share account credentials with unauthorized users.
• Exceed the device or simultaneous connection limit of their plan.
• Resell, redistribute, or commercially provide access to a personal VPN plan.
• Attempt to bypass account, connection, device, or server restrictions.
• Use another customer's account or VPN configuration without authorization.

Customers purchasing reseller or group services may provide VPN access only within the limits and permissions provided by their specific plan.

5. Acceptable Use

NixeSolutions services may not be used for unlawful, abusive, or malicious activity.

Prohibited activity includes, but is not limited to:

• Distributing malware or malicious software.
• Phishing or credential theft.
• Sending spam or unsolicited bulk communications.
• Operating botnets.
• Conducting denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks.
• Attempting to gain unauthorized access to networks, accounts, systems, or devices.
• Scanning, exploiting, or attacking third-party systems without authorization.
• Distributing illegal content.
• Using the service in violation of applicable laws or regulations.
• Intentionally interfering with the operation of NixeSolutions infrastructure or other customers.

Private Server DDoS Abuse

Private VPN server customers are strictly prohibited from using their server to send, launch, facilitate, relay, or participate in DoS or DDoS attacks against any network, server, service, or individual.

If a private VPN server is determined to be involved in sending or facilitating a DoS or DDoS attack, the service may be terminated immediately without warning and without refund.

This policy applies regardless of whether the attack directly targets NixeSolutions infrastructure or a third party.

NixeSolutions reserves the right to restrict, suspend, or terminate services that create a security, legal, operational, or network risk.

6. Violations and Enforcement

NixeSolutions may investigate suspected violations of these Terms.

Depending on the nature and severity of the violation, enforcement may include:

• A warning.
• Temporary restriction of service.
• Suspension of the account or VPN service.
• Permanent termination of service.
• Removal of access to specific servers or locations.

Minor first-time violations may receive a warning when appropriate.

Serious abuse, illegal activity, intentional network attacks, fraud, or repeated violations may result in immediate termination without prior warning.

Customers using a private VPN server to conduct or facilitate DoS or DDoS attacks are not entitled to a warning and may have their service immediately terminated without refund.

Accounts terminated for violating these Terms may not be eligible for a refund.

7. Service Availability

NixeSolutions strives to provide reliable and continuously available VPN services; however, uninterrupted or error-free service cannot be guaranteed.

Service may occasionally be affected by:

• Server maintenance.
• Network maintenance.
• DDoS attacks or other malicious traffic.
• Upstream provider outages.
• Hardware or software failures.
• Emergency maintenance.
• Events outside the reasonable control of NixeSolutions.

Server locations, IP addresses, routing, network providers, protocols, and other service features may be changed when necessary to maintain security, reliability, or performance.

Temporary outages or maintenance do not automatically qualify for a refund.

8. Service Changes

NixeSolutions may add, remove, replace, or modify VPN servers, locations, network providers, protocols, software, features, or infrastructure when reasonably necessary.

We may also discontinue services or plans. When practical, customers affected by significant service changes will be provided with reasonable notice.

9. Cancellations

Customers may cancel recurring VPN subscriptions at any time through the available account or billing controls.

Cancellation prevents future renewals but does not automatically provide a refund for the current billing period.

Unless otherwise stated, customers may continue using the service until the end of the period already paid for.

10. Chargebacks and Payment Disputes

Customers should contact NixeSolutions before initiating a payment dispute whenever possible so that billing issues can be investigated.

Fraudulent, abusive, or unauthorized chargebacks may result in immediate suspension or termination of associated accounts and services.

NixeSolutions reserves the right to provide relevant transaction, account, login, and service-delivery information to the payment processor when responding to a payment dispute.

11. Customer Responsibility

Customers are responsible for:

• Maintaining the security of their account.
• Protecting VPN configuration files and credentials.
• Ensuring their use of the service complies with applicable laws.
• Ensuring devices connected through their account are authorized.
• Maintaining compatible devices, software, and internet connectivity.

Any activity performed through a customer's VPN credentials, configuration files, or private VPN server may be treated as activity associated with that customer's account.

12. No Guarantee of Specific Performance

VPN performance can vary depending on factors outside the control of NixeSolutions, including:

• Customer internet connection.
• Physical distance from the VPN server.
• Network congestion.
• Third-party routing.
• Internet service provider restrictions.
• Device performance.
• VPN protocol configuration.

NixeSolutions does not guarantee a specific latency, download speed, upload speed, routing path, or connection quality unless explicitly stated otherwise.

13. Third-Party Services

NixeSolutions may rely on third-party hosting providers, network providers, payment processors, DDoS protection providers, software providers, and other infrastructure partners.

NixeSolutions is not responsible for failures, outages, restrictions, or changes caused solely by third-party services outside our reasonable control.

14. Limitation of Liability

To the maximum extent permitted by applicable law, NixeSolutions will not be liable for indirect, incidental, special, or consequential damages arising from the use or inability to use our services.

This includes, but is not limited to:

• Loss of data.
• Loss of profits or revenue.
• Service interruptions.
• Connection failures.
• Network outages.
• Loss of access to third-party services.

Customers use NixeSolutions services at their own risk.

15. Termination

NixeSolutions reserves the right to suspend or terminate an account or service when reasonably necessary for:

• Violations of these Terms.
• Fraud or payment abuse.
• Illegal activity.
• Network abuse.
• Security threats.
• DoS or DDoS attacks.
• Attempts to compromise NixeSolutions infrastructure.
• Repeated violations after previous warnings.

Private VPN servers used to send or facilitate DoS or DDoS attacks may be terminated immediately without notice and without refund.

Termination for abuse or violation of these Terms may occur without refund.

16. Changes to These Terms

NixeSolutions may update these Terms of Service from time to time.

The updated version will be posted with a revised Last Updated date. Continued use of NixeSolutions services after updated Terms become effective constitutes acceptance of the revised Terms.
